1. Preamble

1.1 | General Term

These General Terms and Conditions of Sale constitute the entire agreement between the Parties listed below regarding transactions carried out on the website https://tabacbesson.ch/.

1.2 | Definitions

The Seller or the Company refers to Tabac Besson SA, registered under IDE number CHE-172.550.783, with its registered office at Rue de Bourg 22 – 1003 Lausanne – Switzerland, specialized in the sale of cigars, tobacco-related products, accessories, and preservation goods.

The Buyer or Customer refers to any natural or legal person making a purchase via the Seller’s website.

The Order refers to a contractual commitment between Buyer and Seller.

The Website refers to the online platform operated by Tabac Besson SA.

Products and Services include all items available for sale.

A Business Day means any day from Monday to Friday, excluding public holidays.


2. Products and services

2.1 | Product Range

Our website offers various products related to cigar consumption and preservation, including but not limited to cigars, cigarillos, cigar boxes, cigar cutters, lighters, matches, and humidors.

2.2 | Availability Status

  • In stock: Product available for immediate shipping.
  • Available: Product available within 1–2 business days.
  • Out of stock: Product currently unavailable.

2.3 | Stock Management

We strive to keep product availability up to date. If a product becomes unavailable, our customer service will promptly contact the client to offer an alternative solution.

2.4 | Product Information

Descriptions, technical features, and images are for reference only and may differ from the actual product. The Company declines any responsibility for possible inaccuracies or omissions.


3. Price

All prices are displayed in CHF and include or exclude VAT depending on the shipping destination. Shipping costs and import taxes are calculated during checkout.

The Company reserves the right to change prices at any time without prior notice.


4. Order Process

4.1 | Product Search

To place an order, browse our product categories. Once you find the desired product, select the quantity and add it to your cart. A minimum order of 200 CHF, excluding shipping costs, is required to complete the purchase.

4.2 | Cart Validation

Click “Validate Cart”, enter your billing and shipping information, and choose a payment method. You must confirm that you have read and accepted these Terms and Conditions before finalizing your purchase.

4.3 | Checkout

Click “Order” to access a secure payment platform. Most payments use 3D Secure to verify the cardholder’s identity.

4.4 | Order Confirmation

After payment validation, a confirmation email with order summary and shipping details will be sent. A tracking number allows you to follow the delivery.


5. Payment

5.1 | Payment Methods

Accepted cards: American Express, Diners Club, Maestro, Mastercard, VISA, and TWINT. Card payments must be made by the legal cardholder. Bank transfers must be received within 5 business days.

5.2 | Transaction Security

All communications are secured via HTTPS/SSL. The payment platform complies with PCI DSS international standards.

5.3 | Additional Verification

The Company may conduct additional verification to prevent fraud. Orders are only shipped after full validation.

5.4 | Consent

By placing an order, the Buyer consents to the necessary verifications and cooperates if required.

5.5 | Right to Cancel

The Company may cancel orders for reasons such as stock unavailability, pricing errors, or previous disputes. Refunds will be made using the same payment method.


6. Modification, Cancellation & Refund

  • Any modification or cancellation must be requested by email within 2 business days of order confirmation.
  • Cancellation fees:
  • < 500 CHF → 50 CHF
  • 500 CHF → 20% of total order amount
  • Refunds are processed using the original payment method after deducting applicable fees.


7. Shipping and return of packages

7.1 | Shipping Terms

All orders placed on our website are processed under EXW (Ex Works) terms. The seller’s responsibility is limited to making the products available at its premises.

Responsibility transfers to the Buyer when products leave our warehouse. The Buyer assumes all risks and costs related to transport, including loss or damage.

Deliveries are made exclusively in Switzerland and Liechtenstein.

A notification email with tracking information is sent after shipment.

7.2 | Shipping Methods

  • In-store pickup: available within 5 business days after order confirmation. The customer has 10 days to collect the order.

7.3 | Shipping Times and Costs

  • Switzerland: 1–3 business days.
  • Times are indicative and may vary due to external factors.

7.4 | Quality Control and Specialized Packaging

Products are inspected and carefully packaged. Humidors and cigar boxes are sealed to maintain optimal humidity.

7.5 | Returned Packages

Packages returned due to incorrect address, refusal of import taxes, or similar reasons will be sent back to the sender. Return and repackaging fees apply.

7.6 | Refunds

Refunds are conditional on receipt and inspection of the package. All costs related to return, repackaging, or damages will be deducted.


8. Returning goods and complaints

  • Returns possible within 2 business days of receipt with written approval.
  • Not accepted: wrong taste choice, personalized products, altered packaging.
  • Procedure: photos + video of the package and products sent to customer service.


9. Warranties and Responsibilities

  • Quality guarantee: seals and certifications for all Cuban cigars.
  • Limitation: damage due to improper storage, resale outside Switzerland.
  • Right of withdrawal: final sale under Swiss law.


10. Personal data protection policy

  • Collection limited to necessary data.
  • Usage: order management, communication, marketing with consent.
  • Secure storage and sharing only with service providers.
  • Rights: access, correction, deletion, objection.


11. Intellectual property

Any infringement of intellectual property rights may result in civil or criminal action.


12. Applicable law and competent courts

  • Swiss law applies.
  • Disputes are subject to the competent courts in Lausanne.


13. Revision of the T&Cs

The Company may amend the Terms and Conditions at any time. Changes take effect upon publication on the website.
